In order to give an opportunity of hearing to the petitioner and considering it expedient in the ‘interest of justice’ the Allahabad High Court has recalled its order through which the Court had dismissed the petition for withdrawal of approval of ABES Engineering College, Ghaziabad.
The Petitioner, Advocate Vijay Kumar Srivastava, has lost his son because of an electric shock from an electric pole situated in the campus of ABES Engineering College, Ghaziabad. The Petitioner had approached the High court seeking for the withdrawal of approval of the College. The Court has dismissed the plea and passed the order in favour of ABES Engineering College.

The petitioner has again approached the Court for recall of the passed order on the ground that he was not heard before passing the final order.
The Division Bench comprising of Justice Pankaj Mithal and Justice Dr. Yogendra Kumar Srivastava has allowed the plea and observed that,
“The petition was taken up and decided during Covid-19 Pandemic when the regular working of the Court was disturbed. It appears that though the Court had perused the record and passed a final order that the petitioner himself was not heard while passing the said order.”
