Madhya Pradesh high court considering a writ petition on Wednesday ordered the Private School Association, Indore, Association of Unaided Schools, Indore and the Daly College (Indore) to not to charge penal rent or evict families of teachers/employees from their residences.
The petition was filed by a student seeking relief from aggrieved teachers working in private aided and private unaided schools affiliated to CBSE and Senior Secondary Board of Education. The petitioner contended that teachers were being harassed as full salaries were not given to them even though a hefty fee was charged from the students for online classes. The petitioner further state that teachers were thrown out of their residences, giving one such example of Daly College and further submitted that they were charging damages and exorbitant rates from the families. The petitioner stated that many teachers retired since the imposition of nation-wide lockdown due to COVID-19 and some of the teachers had expired. The schools had been acting mercilessly, throwing out the families of such teachers who had been retired or expired, without considering the circumstances of the global pandemic and further stating that schools had been withholding the terminal dues of teachers forcing them to pay rents. The petitioner stated before the court that the teachers were ready to pay normal rent that they were paying prior to 01/01/2020.
The divisional bench of Justice S.C Sharma and Justice Shailendra Shukla found that the petitioner’s case had merit for grant of interim relief and the court directed the respondents to not to charge any damage/penal rent from the teacher or their families and they shall not be evicted from their residences.
The court said “At present, it is very difficult to find out the other accommodation and shifting of the family is also very difficult” and ordered the respondents to allow the teachers and their families their accommodations on normal rent that was charged prior to 01/01/2020. The court further directed he respondents to pay teachers their terminal dues which were withheld by the respondents and issue notice for payment of their PF also. The court directed the district magistrate, Indore to ensure compliance of the order and listed further hearing on 02/11/2020.
