HC grants anticipatory bail to an advocate alleged in assault case with police officer [Read Order]


The Allahabad High Court has granted anticipatory bail to an Advocate Arpit Bisht and granted time period of three weeks to state to obtain instructions in this matter and file counter affidavit.

The single bench of Justice Siddharth while allowing the bail application filed by Advocate Arpit Bisht has ordered that,

“The applicant, Arpit Bisht, shall be enlarged on interim anticipatory bail in Case Crime No. 1175 of 2020, under Section- 395 I.P.C., Police Station- Noida Sector-20, District- Gautam Budh Nagar, on his furnishing personal bond of Rs. 50,000/- and two sureties each of like amount before the Station House Officer of Police Station/Court concerned with some conditions."

The allegations in the FIR are that when a policeman went to ICICI Bank, Sector- 18, Noida for investigation of a case, he was attacked by 5-6 unknown accused persons and his pistol was snatched. The applicant in also involved in this incident.

The counsel on the behalf of applicant has submitted that the applicant was not named in the FIR. He went to the spot only on receiving the phone call of one Sarthak Tyagi, who is his friend and after the situation got out of control he left the place in a car with his friend. He had no role in the incident and has been falsely implicated in this case. It was also stated by applicant that he has no criminal history to his credit.

The counsel on behalf of respondent has submitted that he has not received instructions in this case. Notice was only served in the office of Government Advocate on 28.12.2020. The counsel has prayed before the court to grant sometime to obtain instructions in this case to assist the court.

The court while allowing the bail application and granting the prayed time period to respondent to file counter affidavit has listed the present matter on 21th January for next hearing.
