On Wednesday, the Delhi High Court has ordered Bar Council of India to issue the Standard Operating Procedure for physical conduct of the All India Bar Exam (AIBE) scheduled for January 24, 2021, amid the pertaining COVID-19 pandemic.
During hearing of a petition filed by a Laywer seeking conduct of AIBE via Online Mode, the single-Judge Bench of Justice Prateek Jalan directed BCI to issue the SOP at least one week prior to the exam.
Last year, in response to the petition, the BCI had informed the Court that it was not feasible to hold the exam via online mode. It rejected the option BCI rejected the option of on the ground that most Lawyers didn't reside in metro cities/Class-1 cities and this would lead to glitches such as internet speed and connectivity.
In the hearing today, the petiotioner-Lawyer informed the Court that AIBE was scheduled to take place on January 24 through offline mode. He also reiterated that the period ranging from March 24, 2020 to March 31, 2021 stood excluded from the two-year period within which an Advocate was mandated to clear AIBE.
Keeping in view the BCI's stand on the exam, Petitioner-in-person, Middha submitted that his petition would stand satisfied if the BCI issued an SOP in regard to the COVID-19 pandemic situation.
The Court thus duly took note and dismissed the petition with directions to the Bar Council of India
