HC directs officials to pay salary of a teacher which was stuck for last five years

The Allahabad High Court has directed the District Inspector of Schools and the Finance Accounts Officer, Ballia to file their personal affidavits indicating the reasons for the delay in disposing of the matter of the petitioner.

The Single Bench of Justice Salil Kumar Rai while dealing with a petition filed by Parmatma Nand Singh for payment of his pending salary which has been stuck for last five years in the office of the District Inspector of Schools, Ballia, has directed to District Inspector of Schools and the Finance & Accounts Officer to dispose the matter with in two weeks. The court has directed,

“The District Inspector of Schools and the Finance & Accounts Officer in the office of the District Inspector of Schools shall dispose of the matter relating to the petitioner within two weeks from today and in any case, latest by 26th of February, 2021.”

It has submitted before the court that the letter dated 26.5.2015 was written by the Director of Education (Secondary) to the District Inspector of Schools to verify the alleged arrears of salary of the petitioner. After that the District Inspector of Schools, Ballia vide his order dated 6.2.2021 has directed the Finance & Accounts Officer, Secondary Education, Ballia to verify the arrears of salary accruing in favour of the petitioner as a consequence of pay fixation.

But the matter regarding the petitioner remained pending in the office of the District Inspector of Schools, Ballia for 5 years shows the negligence of the District Inspector of Schools, Ballia. The Court while listing the present matter on 2 nd March for next hearing has directed the respondent to submit the reasons for the delay in disposing of the matter of the petitioner.
