A Single Judge Bench of the Madras High Court, comprising of Justice M Nirmal Kumar, has observed, in the case of M/s. Trans-Pacific Logistics Pvt. Ltd v. The Commissioner of Police & Ors., that a Civil dispute has to be adjudicated between the parties before a Civil Court and the Police has no role to play in it.
Background of the Case
In this case, the Petitioner Company was harassed by the Police without having any appropriate orders. Aggrieved by this, the Petitioner approached the Court. Therefore, this Criminal Original Petition was filed under Section 482 of the Code of Criminal Procedure, to seek direction to respondents two and three- not to harass the petitioner company and its directors without any due process of law

“nature of the dispute involved in this case is civil in nature, it is for the parties to adjudicate the same before the appropriate Civil Court and the Police will have no role to play in a case of this nature.”
The Court ordered that the Respondents were not entitled to interfere in any civil dispute. Hence, the Court disposed of the Criminal Original Petition with a direction to the respondents not to interfere with the civil disputes pending between the parties without imposing any cost on it.
